Legal Translation Services for Alien Tort Act

The US Supreme Court last week heard oral arguments on the Kiobel v. Royal Dutch Petroleum Company. The issue being heard is whether or not the Alien Tort Act allows foreign plaintiffs to sue US corporations for certain human rights violations. However, upon oral arguments, the questioning veered towards the broader question of whether the United States Courts could even hear human rights cases when the alleged abuses occurred outside the United States.
In a unique change of course, the Court indeed opted to focus on this broader question, ordering:
“This case is restored to the calendar for re-argument. The parties are directed to file supplemental briefs addressing the following question: Whether and under what circumstances the Alien Tort Statute, 28 U.S.C. 1350, allows courts to recognize a cause of action for violations of the law of nations occurring within the territory of a sovereign other than the United States.”
Supplemental briefs are due by May 3rd with the re-argument not scheduled to happen until sometime after July. So watch this legal translation blog for details.
